Bora CREDIT Terms of Service
1. Acceptance of Terms
By accessing or using the services provided by Bora CREDIT ("Services"), you agree to the following:
- These Terms of Service, including any amendments or updates.
- Our Privacy Policy, which governs how we collect, use, and protect your information.
- All applicable laws, regulations, and industry standards governing financial services in the Republic of Kenya.
If you do not agree to any of the terms, you must immediately cease using our Services.
2. Service Description
Bora CREDIT offers a range of digital financial services, including but not limited to:
- Credit Assessment Solutions: We provide tools to evaluate an individual’s or entity’s creditworthiness based on transaction histories, financial behaviors, and risk indicators.
- Loan Facilitation Services: We help users secure loans by connecting them with financial institutions, as well as providing eligibility assessments and risk analysis.
- Financial Risk Management Tools: Our services include predictive analytics, fraud detection systems, and compliance risk assessments to safeguard your financial operations.
3. User Obligations
3.1 Account Management
To use our Services, you agree to the following account management responsibilities:
- Provide accurate, complete, and up-to-date information during the registration process.
- Maintain the confidentiality of your login credentials and notify us immediately if you suspect unauthorized access to your account.
- Be responsible for all activities that occur under your account.
3.2 Permitted Use
You agree to use our Services solely for lawful purposes and in compliance with the applicable laws of the Republic of Kenya. Specifically, you agree not to:
- Reverse engineer, decompile, or otherwise attempt to derive the source code or underlying structure of any software or system used in providing our Services.
- Use the Services for any fraudulent, illegal, or unlawful activities.
- Attempt to bypass or circumvent any security or technological protections implemented by Bora CREDIT.
4. Data Practices
4.1 Collection & Use
We collect and process the following types of data to provide our Services effectively:
- Financial SMS Data: We collect transaction details sent via SMS for the purpose of assessing your creditworthiness and financial behavior.
- Device Information: We collect information related to the device you use, including but not limited to your device’s identifiers and configuration details, for security and fraud prevention purposes.
- Personal and Financial Information: This includes details such as name, contact information, bank account details, and income data for the purposes of loan facilitation and credit assessments.
4.2 Data Sharing
Your data may be shared with third parties in the following instances:
- To regulatory authorities, in compliance with the applicable laws in Kenya.
- To payment processors and financial institutions involved in the provision of financial services or loan facilitation.
- To audit partners or legal authorities, under a non-disclosure agreement (NDA) to ensure compliance and security of the Services.
5. Intellectual Property
All intellectual property rights, including copyright, patents, and trademarks, related to the Services, including:
- Software algorithms and underlying technology;
- User interface designs, graphical elements, and layout;
- Analytics models, databases, and proprietary content;
are the exclusive property of Bora CREDIT and are protected by copyright, trademark, and other intellectual property laws. You may not use any of our intellectual property without express written permission.
6. Termination & Suspension
6.1 Account Closure
Your account may be closed under the following conditions:
- If there are no pending transactions or balances on your account.
- If your account is in good standing with no violations of these Terms.
- If there are no active investigations or unresolved issues regarding your account.
6.2 Service Suspension
Bora CREDIT may suspend access to the Services in the following scenarios:
- If we suspect fraudulent or unauthorized activity.
- For maintenance or upgrades to the Services.
- If required to comply with regulatory requirements or orders from Kenyan authorities.
7. Liability Limitations
Bora CREDIT shall not be liable for:
- Any indirect, incidental, or consequential damages arising from the use or inability to use the Services.
- Failures of third-party services, such as financial institutions, payment processors, or telecommunications providers.
- Data loss or system outages due to force majeure events beyond our control, including natural disasters, network failures, or cybersecurity attacks.
Our total liability in any event shall not exceed the amount you have paid to Bora CREDIT for the Services in the preceding 12 months.
8. Dispute Resolution
- Governing Law: These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of Kenya.
- Arbitration: Any disputes or claims arising out of or in connection with these Terms shall be resolved through binding arbitration in Nairobi, Kenya, following a 60-day negotiation period.
- Class Action Waiver: You agree that any claims will be resolved on an individual basis, and you waive the right to participate in any class action or collective litigation.
9. Policy Updates
We reserve the right to update or modify these Terms of Service at any time. If we make material changes, we will notify you with:
- A 30-day notice before the changes take effect.
- Continued use of the Services after the notice period constitutes acceptance of the updated Terms.
- Archived versions of the Terms will be available upon request.
